The second test is the statutory bar under Section 7A of the Citizenship Act, 1955. This states that nobody in the same line may have held Pakistani or Bangladeshi citizenship. A perfect lineage claim fails if the second test is not met.

You Are Generally Eligible If
- You were an Indian citizen on or at any time after 26 January 1950, and have since taken up foreign citizenship with respect to OCI card eligibility for foreign citizens.
- You were eligible to become a citizen of India on January 26, 1959; this covers people from territories that joined indian after that date.
- You belong to the territory that became a part of India after August 15, 1947, such as Goa, Daman and Diu, Puducherry, or Sikkim.
- You are the child, grandchild, or great-grandchild of anyone in the following categories.
- You are a minor whose parents are both citizens of India or one of your parents is an Indian citizen.
- OCI card eligibility spouse rules say that you are eligible if you are the foreign national spouse of a citizen of India or an OCI cardholder, and your marriage has been registered for two consecutive years.
You Are Not Eligible If:
- You are or have ever been a citizen of Pakistan or Bangladesh.
- Either parent, any grandparent, or any great-grandparent held Pakistani or Bangladeshi citizenship, regardless of how strong the rest of the lineage is.
- You have served in a foreign military. This is a discretionary bar and is assessed case by case, but it is rarely waived.
- Your Indian ancestry runs further back than the great-grandparents. The statute stops here.
- You still hold Indian citizenship. An OCI card is exclusive to foreign nationals; you would need to renounce first, which is a separate and irreversible process.
A note on the Pakistan/Bangladesh Bar: The parties are frequently ambiguous, and the families sometimes assume a bar does not apply. Where the history is genuinely unclear, it is worth having the documents read before you accept a negative answer.

The PIO scheme was merged into the OCI in January 2015. If you had an old PIO card, it is treated as an OCI card, though converting it formally is advised because the airlines and the immigration desks are increasingly rejecting the PIO card as a legacy document.
